HARASSMENT: A HOLISTIC VIEW


Harassment covers a wide range of behaviors of an offensive nature. It is commonly understood as behavior that demeans, humiliates or embarrasses a person, and it is characteristically identified by its unlikelihood in terms of social and moral reasonableness. In the legal sense, these are behaviors that appear to be disturbing, upsetting or threatening. They evolve from discriminatory grounds, and have an effect of nullifying or impairing a person from benefiting their rights. When these behaviors become repetitive, they are defined as bullying.

Some examples of harassing behavior include making fun of an employee’s religious beliefs or referring to foreign-born employees using derogatory stereotypes. The harasser can be the victim’s supervisor or co-worker, client, vendor, or other non-employee. The victim does not have to be the person directly harassed, but can be anyone affected by the offensive conduct.

The “work environment” is defined broadly for these purposes: It include not only the employer’s premises during work hours, but also wherever and whenever the employee is working for the employer, such as at a client’s site, a trade show, or a conference. Even some work-related social events, such as the employer’s annual staff party, Office offsite get together may be deemed the work environment too.

The most familiar type of harassment is sexual harassment, which includes acts such as touching a coworker inappropriately, engaging in derogatory stereotyping about one gender, telling obscene jokes, displaying pornographic images, or offering job advantages in return for sexual favors. The victim can be a man or a woman, and the harasser doesn’t have to be of the opposite sex for the conduct to be illegal.

As a manager, what can you do to minimize the risk of unlawful harassment in your workplace?


  • Be a positive role model: Avoid engaging in conduct that could reasonably be viewed as harassing.
  • Address inappropriate behavior even before it rises to the level of illegality.
  • Make sure your organization has a clear written policy prohibiting all types of workplace harassment, and establish a confidential complaint procedure for employees to report suspected harassment.
  •  Train both supervisors and non-supervisors about harassment prevention as a part of new -hire orientation, and provide refresher courses periodically.
  •  If you receive a complaint of harassment or otherwise become aware of it, move promptly to investigate and, if you decide that the behavior described in the complaint really was harassment or other inappropriate conduct, take action to remedy the problem immediately.
  •  handle any harassment investigation with care and discretion to avoid legal claims from not only the complaining employee but also the accused harasser.
  •  Ensure that employees who make complaints of harassment in good faith do not suffer retaliation.
To Conclude, Harassment refers to a wide variety of behavior which can violate both civil and criminal laws. What constitutes criminal harassment varies by state, but it generally entails targeting someone else with behavior meant to alarm, annoy, torment or terrorize, and creating reasonable fear in the victim for their safety or the safety of their family.
